Watchdog Group Poll: Most Arizonans Want Stump's Texts Released

stumpyAlmost 80 percent of Arizona voters polled on the subject said they want the Arizona Corporation Commission to release text messages sent by regulator Bob Stump, according to a survey commissioned by the clean-energy watchdog group fighting for those records.

The Checks and Balances Project has been fighting almost a year to access text messages Stump sent during the 2014 election. The organization's executive director, Scott Peterson, said it is suspicious that Stump was messaging an official at Arizona Public Service Co. and the head of a dark-money political group who supported commission candidates.

Peterson released some of the survey results Monday, ahead of a Tuesday court hearing that could determine whether the messages are released or whether his group's legal challenge is dropped.

"It's pretty clear that Arizonans are unhappy with their conduct," Peterson said. "It's unfortunate we have to go to court to get basic records from a taxpayer-funded cellphone, but Stump and the Commission's senior staff have left us little choice."

Checks and Balances contracted with Pulse Opinion Research, which polled 500 likely Arizona voters March 1-3. The survey found 79 percent want Stump's messages released and more than half do not believe all the texts were personal.

The full survey was not released, but Peterson said that only 25 percent of respondents said they have not followed the Corporation Commission story at all. Thirty-four percent said they have not followed it very closely, 28 percent "somewhat closely" and 12 percent report following it "very closely."

Stump has said that Checks and Balances is on a political "witch hunt" and would likely continue to harass regulators even if he releases his personal text messages publicly. He has said, many times, that the aim of Checks and Balances is to intimidate regulators from cutting subsidies for rooftop solar.

The Checks and Balances Project, which has partially been funded by SolarCity Corp., sued the Arizona Corporation Commission in Superior Court in October to access Stump's texts.

Checks and Balances has criticized the Arizona Attorney General's Office, which had the phone because of another investigation. Peterson said that Attorney General Mark Brnovich's office made a strange decision in asking Pinal County Sheriff Paul Babeu to assist with the investigation.

“Why would the Attorney General’s office seek help in downloading the contents of Commissioner Stump’s phone, not from the Phoenix police or the state police or Tucson or even Flagstaff, but instead from Pinal County Sheriff Paul Babeu?" Peterson said. "Did Sheriff Babeu’s office have the latest forensic technology? No, he did not.”

The text messages retrieved from the phone by the Attorney General's Office and Babeu's office were provided to former judge Dave Cole, who was serving as a "Special Master" to determine if the texts were public records.

Certain documents, such as personal notes or an attorney's advice, are not subject to be disclosed by the state public records law.

Cole spent 43 hours reviewing hundreds of pages of data downloaded from Stump's phone and determined none of it should be released.

"The nature of most of the texts was private," Cole said in an interview with The Arizona Republic. "There was nothing that met the definition of a public record."

Checks and Balances is fighting for a more thorough explanation of what Cole saw and why the information is not subject to be released. The Corporation Commission is asking Superior Court Judge Randall Warner to dismiss the matter.

Dan Barr, the attorney for Checks and Balances, provided the court with a list of 3,598 messages he wanted reviewed. The list includes 18 contacts and the dates and times of messages that Checks and Balances wanted to review under Arizona's public-records law. The list was culled from a log Verizon Wireless provided. Verizon said in a letter to the commission that it couldn't retrieve the messages themselves.

Cole said the Attorney General's Office estimated there were 13,000 or more text messages sent by the phone, and five different software tools were used to retrieve them.

Cole was provided with hard copies of text messages retrieved with each tool. He said the documents ranged from about 150 pages to about 500 pages, and he spent 43 hours examining them to find matches to the messages that Barr was seeking.

One of the problems was that the software used to retrieve the deleted texts did not provide meaningful information, Cole said.
